On February 14, 2019, International Law Office (ILO) and Lexology announced the winners of this year's Client Choice Awards.
Claude Lambert (partner, Corporate | M&A) has been announced for the third time as the exclusive winner of the General Corporate award for Switzerland.
Established in 2005, Client Choice recognizes those law firms and lawyers around the world that stand apart for the excellent client care they provide and the quality of their service. The criteria for this recognition focus on the ability to add real value to clients' businesses above and beyond the other players in the market.
Law firms and lawyers can be nominated for the Client Choice Awards programme only by corporate counsel. The winners for 2019 were chosen from a pool of more than 2,000 nominations.
The partners of Homburger are pleased to announce that Roman Baechler became partner of the firm on January 1, 2019.
Roman Baechler studied law at the University of Zurich, from which he obtained his doctorate. After having been admitted to the bar in Switzerland, he joined Homburger as an associate in 2010. He graduated with a Master of Laws (LL.M.) from Columbia Law School in 2014. His practice focuses on domestic and commercial litigation.
L’abolition de la publication du LIBOR est prévue pour la fin de l’année 2021. Le LIBOR reste néanmoins la valeur de référence à l’heure actuelle sur le marché Suisse pour les obligations à taux variable en raison de l’inexistence de taux d’intérêts de remplacement adéquats. Par conséquent, les banques suisses sont confrontées au défi, en particulier dans le domaine des hypothèques, de s’assurer d’ores et déjà lors de la conclusion de nouveaux contrats, du passage du LIBOR à un futur taux d’intérêt de remplacement. Ce défi existe tant pour les affaires avec les clients institutionnels qu’avec les clients privés.
Les associés René Bösch et Benedikt Maurenbrecher, Homburger, ont développé une proposition quant à la forme qu’une telle clause de remplacement du LIBOR pourrait prendre pour le marché suisse des prêts aux clients privés. Le but était de développer une clause qui prévoit un accord équitable pour le remplacement du LIBOR et soit simple et compréhensible pour les clients privés. Celle-ci s’intègre aux principes traditionnels du droit suisse.
Vous trouverez ci-joint la proposition de clause développée, avec quelques remarques, que René Bösch et Benedikt Maurenbrecher ont présentés le 31 octobre 2018 au Groupe de travail national sur les taux d’intérêt de référence – en langue allemande et française, ainsi qu’une traduction en anglais.

At this year's Who's Who Legal (WWL) award ceremony, held on May 8, in London, René Bösch was awarded "Capital Markets Lawyer of the Year" for the second time.
Based on their in-depth research with law firms and clients, WWL annualy identifies and awards individuals and firms that have performed exceptionally from 34 practice areas, and other disciplines and recognitions.
René Bösch is a partner at Homburger since 1998 in both the Capital Markets and the Banking and Finance teams. An expert in capital market transactions and financial markets regulation, he is particularly focused on debt capital market transactions and the structuring of equity-linked and regulatory capital instruments.
At the 19th annual IFLR European Awards on April 19, 2018 in London, Homburger received the award for "M&A Deal of the Year" for advising ChemChina in its acquisition of Syngenta. The award honors Homburger's involvement in one of the most complex M&A transactions of the year 2017.
In addition to winning this award, Homburger was also shortlisted in the same category for advising Johnson & Johnson in its acquisition of Actelion.
The International Financial Law Review (IFLR) recognizes annually the most innovative international legal deals of the past year and the respective firms.
DSAT, a new tool permitting companies to self-assess their data protection compliance under the upcoming EU General Data Protection Regulation (GDPR) and revised Swiss Data Protection Act (based on the current draft) has been released. Developed by Homburger counsel David Rosenthal with selected clients, it is now been made available to the public for free on its own website www.dsat.ch. Homburger associates Luca Dal Molin and Giulia Boccadoro assisted in its creation. Further content is to follow. In the first two days online it already recorded over 1'000 downloads. The editorial board is formed by David Rosenthal and David Vasella (Walder Wyss).

At the 14th annual Managing IP – Global IP Awards on March 8, 2018, Homburger received the award for "Switzerland – IP Transactions & Advisory Firm of the Year 2018". Representing Homburger's IP | IT team, partner Andri Hess as well as associates Luca Dal Molin and Roman Perrig received the award at the ceremony in London.
The awards recognize outstanding intellectual property work by law firms around the world. Managing Intellectual Property is one of the leading sources of news and analysis on intellectual property developments worldwide. The respective magazine has been issued by independent legal publisher Euromoney Legal Media Group for over two decades.
For the second year, WWL shines the spotlight on the pre-eminent lawyers aged 45 or under at the end of 2018, who the market considers to be the future leaders of the arbitration profession. The research covers law firms and independent practices, a total of 522 individuals with exemplary standing as arbitrators and counsel.
In the Europe – Non-Partners section of the analysis, two of our lawyers are ranked as "Most Highly Regarded".
Winner of this Europe-wide section is counsel Melissa Magliana who is considered "the very best young arbitration practitioner in Switzerland" and impresses peers with "her incredible ability to find the ideal middle ground between utmost legal precision and a sensible, practical approach".
In tenth place, associate Stefanie Pfisterer is mentioned, who is stated a "technically brilliant" lawyer with vast experience before both Swiss and international tribunals.
Two further associates are listed as Future Leaders, Mladen Stojiljkovic and Simon Vorburger.

On February 19, 2018, Asia Business Law Journal’s 2017 "Deal of the Year Award" was awarded to Homburger for the takeover of Endurance by Sompo.
The winning deals have been chosen based on a number of factors, not just large monetary values. The overall significance, complexity and innovative nature of the deals were also considered, as well as the deal size and broader interests.
