Successful defense in an ICC arbitration

Homburger represented a multinational pharmaceutical group in successful defense of a claim filed by its U.S. distributor for over USD 209 million in alleged lost profits. The dispute turned on allegations of serious breaches of the FDA Good Manufacturing Practices. The ICC arbitral tribunal rejected such accusations and dismissed the distributor’s lost profits claim.
